Ricardo Alberto and Luis Enrique Martinelli Linares , detained since last Monday in Guatemala at the request of the United States, had a safe-conduct validated by the Ministry of Commerce and Industries (MICI) , which would have allowed them to move around the country, despite sanitary restrictions imposed by the coronavirus pandemic .

The two sons of former President Ricardo Martinelli Berrocal were detained in Guatemala last Monday, when they were waiting for a private flight that would bring them to Panama, after years without knowing their whereabouts.

Luis Enrique left Panama on October 16, 2015 and has not registered migratory movements since then. This information regarding his brother Ricardo Alberto is unknown.

The brothers’ whereabouts have been a mystery for the past five years, but on November 20, 2018, they were detained in Miami. Then, the US immigration agents indicated that, although they had entered the country legally, they no longer had a visa to stay in said territory. They were detained for two weeks at the Krome immigration shelter, until a judge granted bail of $ 1 million each. The United States never deported them or handed them over to Panama, despite requests for extradition to appear in two bribery investigations: the Odebrecht and Blue Apple cases. In these processes, both have bonds not to be detained – of $ 2 million and $ 5 million, respectively – but only Luis Enrique has recorded them.

In Guatemala, they do not know how they entered that country, although the authorities reported that they had been the subject of “surveillance and monitoring work” since June 30. On July 3, the United States’ request for arrest came to Guatemala, which seeks them to answer charges of conspiracy to launder money .

Luis Enrique and Ricardo Alberto intended to return to Panama on a private and “humanitarian” flight, on the aircraft with registration N799RM , owned by their family.

Now they remain in the military prison of Mariscal Zavala , until the extradition process to the United States ends, but the courts will be closed until July 23, due to the pandemic. Their lawyers are against to the arrest, and allege that they have immunity for being substitute deputies of the Parlacen .

The vice president of Parlacen, Gilberto Sucari , points out that there is no record that the brothers have been sworn in.
