There is a confusion. Mr. Martinelli has never appealed the extradition order of Judge Torres, because that order, neither in the United States nor in Panama, allows this recourse, it is not appealable. Therefore, you can not give up what has never been presented. From August 31, 2017, when Judge Edwin Torres endorsed the extradition of Mr. Martinelli, he passed into the hands of the State Department, but that second decision is still pending. There is a detail, knowing that there is no appeal, the defense has tried, without success, to stop the extradition process with habeas corpus. Not counting other discarded actions, the first attempt failed on July 31, 2017, when Judge Clarence Thomas of the Supreme Court of that country rejected the habeas corpus. A second habeas corpus attempt also failed on January 23, 2018, when Judge Cooke denied it. But that second refusal is what the defense announced that it would appeal and now it desisted. They are different things.
