The Electoral Tribunal (TE) processes 747 files of violation of electoral propaganda on the internet and social networks.The files are generated by the Center for Studies and Digital Monitoring of the TE and presented to the Directorate of Electoral Organization for investigation.This week the regulatory body for electoral processes issued various resolutions to order the suspension of political propaganda for failing to comply with article 290 of the Electoral Code. The aforementioned norm establishes that all electoral propaganda on the Internet and social networks must carry a headband with the legend “advertisement paid for…” which must be included in the digital content or in the comment.Various accounts on social networks have avoided placing the headband, which has led to the initiation of administrative proceedings against said accounts by the TE.Political parties and candidates began their electoral campaigns for the primary elections in April, which included the aforementioned guidelines on social networks. The primary campaigns of the political parties have a period of 60 days. All that is spent on them must be registered by the candidates in the expense books, which must be sent to the TE, to verify that the limits established in the electoral law were respected.In the case of people who receive payment or consideration of any kind to promote on social networks for or against an aspirant, pre-candidate, candidate or political party on social networks, the aforementioned headband must be placed before the beginning of their intervention when try videos or live content.Ignorance of the norm does not exempt the owners of the accounts in social networks from sanctions for violating the norm.Once the administrative process is completed, the complaint will be sent to the Electoral Prosecutor’s Office for the corresponding criminal investigation to be carried out.Process to reportAny citizen, without the need for legal representation, can file a complaint at the Electoral Organization Office, send the complaint by email or through the TE’s social network account.In the event that the Electoral Organization determines that the norm that regulates electoral propaganda or opinion studies in digital media has been violated, the provisional suspension of the digital content of electoral propaganda will be ordered by resolution.The provisional suspension order will be communicated to the respective social network so that it can be executed within a period of 24 hours.The social network that does not comply with the suspension order will be penalized in accordance with the provisions of the Electoral Code.sanctionsArticle 588 of the Electoral Code, in its last update of 2023, establishes the amounts for failing to comply with the electoral norm.Individuals who publish digital content without specifying who is responsible for the guideline will be penalized with a fine of one thousand to $5,000.The Electoral Code establishes that individuals must have and publish who is the person responsible for the electoral guideline. Those responsible for the guidelines must be the pre-candidates, candidates or political parties.
