The appeal hearing, scheduled for this Thursday, February 12 ,( TODAY ) seeks to review the precautionary measure imposed by Judge Oris Medina, who ordered house arrest while the Public Ministry’s investigation proceeds.

Prosecutor requests provisional detention for Carrizo

During the proceedings, the Public Prosecutor’s Office will request that the precautionary measure be modified and that Carrizo be placed in provisional detention in a penitentiary , considering the nature of the crime being investigated.

The decision made by the Superior Court of Appeals will be key in determining whether the former vice president will remain under house arrest or face trial while in pretrial detention.

Defense considers the house arrest measure “extreme”

For his part, lawyer Víctor Orobio , a member of the legal team of the former presidential candidate of the Democratic Revolutionary Party (PRD) , described the house arrest measure as “extreme”.

The lawyer indicated that they will request that the measure be replaced by the obligation of periodic reporting , considering that there are no procedural risks that justify a greater restriction.

“It does not represent any danger to the investigation,” Orobio argued, stating that there is no risk of escape.

Defense denies risk of escape

The lawyer Pedro Meilán , also a member of the defense team, recalled that in the initial hearing held in the Accusatory Criminal System (SPA) the Prosecutor’s Office invoked the alleged risk of flight and the nature of the crime.

According to Meilán, those arguments were refuted.

“He turned himself in when he learned of his arrest warrant; it wasn’t an apprehension, but a complete surrender,” the lawyer stated, describing the possibility of escape as “illogical.”

Court to decide amid cross-appeals

It should be remembered that both the prosecution and the defense appealed Judge Oris Medina’s initial decision.

  • The Public Prosecutor’s Office is seeking to increase the provisional detention measure.

  • The defense requests that the periodic reporting requirement be made more flexible.

The ruling of the Superior Court of Appeals will define the immediate course of the legal process against José Gabriel Carrizo , in a case that maintains public attention because it involves one of the most relevant political figures in the country in recent years.
