The Supreme Court of Justice (CSJ) received a claim of unconstitutionality against a ruling by the Electoral Court (TE), which favors Ricardo Martinelli.

Linda Guevara González, acting on her behalf, filed the lawsuit in court and remained in the office of Judge Maribel Cornejo.

Guevara González tries to have the Resolution dated March 22, 2022, issued by the Electoral Tribunal, declared unconstitutional, which is an action for the appeal filed by Alma Cortés, on behalf of Ricardo Alberto Martinelli Berrocal, against resolution 2- 2022 of February 23, 2022, issued by the Second Administrative Electoral Court.

The magistrates of the Electoral Court (TE) revoked in all its parts Resolution number 2 of February 23, 2022 with which the electoral administrative judge, Edmara Jaén, had decided to lift the electoral criminal jurisdiction of former President Ricardo Martinelli.

The request to lift the former president’s electoral jurisdiction was made on February 2 by the Third Criminal Court, where the hearing for the New Business Case is being held.

Judges Heriberto Arauz (Speaker) and Alfredo Juncá endorsed this decision, while Judge Eduardo Valdés Escoffery saved his vote. Judges Arauz and Juncá justified their decision by taking as an argument the existence of the specialty principle, by which the former ruler he was extradited from the United States, so as not to be investigated for crimes other than the puncture case, in which he was found not guilty.
