The appeal to the decision of the Second Administrative Court was presented by lawyer Herbert Young

The plenary session of the judges of the Electoral Tribunal (TE) confirmed this July 29 the decision of the Second Administrative Electoral Court to reject the request for partial annulment of the election and proclamation of deputy Luis Omar Ortega Rivera, in circuit 8-2 of San Miguelito.

In accordance with Edict No. 114-2024-SG, the reporting magistrate was the presiding magistrate of the TE, Alfredo Juncá Wendehake.

The appeal to the decision of the Second Administrative Court was presented by lawyer Herbert Young on behalf of Zulay Leyset Rodríguez.

The plenary session of the magistrates confirmed the decision of the Second Electoral Court to dismiss the claim for annulment in the counting of the votes recorded in nine months of voting in the 8-2 circuit.

In addition, the magistrates ordered the file to be returned to the Second Electoral Court and notify the parties.

After hearing the ruling, Rodríguez indicated that “as expected, the Electoral Court has established the electoral fraud.”

He added that it seemed “incredible, but they didn’t care about the flawed minutes, the illegal decree they used to count the votes, or the irremediable errors in the minutes.”
